So Far, So Good

So far, so good. The courts have not been shut down and on August 23, 2021, a jury came back with the two-word verdict that all defense attorneys like to hear- NOT GUILTY. This was definitely a more engaged jury who had a lot of questions about the case and how it proceeded. Bottom line the prosecutor didn’t anticipate my strongest argument or my ability to persuade the jury. 


I had two other assaultive type cases get favorable results the next week. An Injury to The Elderly felony charge was dismissed on 8-30-21 and I started the month on a high note when my Injury to the Disabled charge was reduced from a 1st degree felony habitual offense (25 years to life in prison) to a misdemeanor credit for time served plea. 


The two felony cases illustrate cases are why it is so important to bond out of jail if possible. The case that was dismissed was a client who bonded out of jail and refused to accept any offer. She professed her innocence from day one.  In the other felony case, in my opinion, it may have had a better trial argument, unique set of facts, but because my guy was in jail, he decided credit for time served on a misdemeanor was all the time he wanted to spend it jail. If he would have decided on a trial, it would have likely been another six months in jail waiting on a trial date.


It appears as if the next couple of weeks are going to be crazy as the courts try to eliminate the backlog of cases set on the trial docket as a result of a year and a half of no trials. Wish me luck.
